3.1. Duration of the license and renewal

Licenses are valid for one year from the date of purchase. To receive updates and support for purchased items, you must have a valid and active license key. You can renew your license when it expires at a 50% discount off the purchase price of a new license.

3.2. Software Updates

Updates are included for free for one year. If you’ve a valid and active license key, and your product(s) supports it, you’ll receive updates automatically from your WordPress dashboard. If your product(s) do not support automatic upgrades, then you can download the updates from “My Downloads” page on your site.

3.3. Support Services

You receive support for purchased products up to one year from the purchase date. If you wish to get support after that, you must renew your license key, purchase priority support access, or purchase a new license for the product you wish to get support for.

4. Ownership and Liability

You are not permitted to claim intellectual or exclusive ownership of our items, whether changed or unmodified. MakeWebBetter owns all of its goods. Our products are offered “as is,” with no express or implied guarantee of any kind. In no event shall our legal entity be liable for any damages, including, but not limited to, direct, indirect, special, incidental, or consequential damages, or any losses resulting from the use or inability to use our products.

5. Warranty

We also do not guarantee that our product(s) will work with all browsers. We also cannot guarantee that they will work with all versions of WordPress. We make no guarantees about compatibility with third-party plugins, scripts, or apps.

6. Updates

Customers who have made a purchase and have an active licence are eligible for product updates. Although all products are designed to be compatible with the most recent version of WordPress, we cannot guarantee that previous items will operate with future versions of WordPress. We are, however, committed to doing our utmost to ensure that all products are compatible with future WordPress updates.

7. Modifications

You are authorized to make any necessary modification(s) to our products to fit your specific needs. You may remove our credit links under the understanding that all themes downloaded are still copyright of MakeWebBetter, and that all files used must retain their respective licenses.

8. Delivery

Your product information will be emailed to your email address after we have successfully received your payment. This could take up to an hour, although it usually happens in minutes. If you haven’t received an email within this time frame, please contact us via our website.

You can also access purchased products from your reserved area on our site after making a purchase.

9. Price Changes

MakeWebBetter reserves the right to change or discontinue, temporarily or permanently, a subscription (or any part thereof) with or without notice. We also reserve the right to change our product prices, anytime without prior notice

10. Photos Copyright Info

Our products are not wrapped with any type of graphic. It is your responsibility to upload your own photographs. However, when viewing our product demos, you will see that we employ a number of photographic photographs. These photos are not included in the package, but are simply for demonstration purposes. They are designed to provide the visitor with a functional preview of what the theme will look like once content has been added.

11. Subscriptions

  • The Company reserves the right and from time to time to change or discontinue, temporarily or permanently, any part of the Service with or without notice.
  • Prices of all Services are subject to change with prior notice from us. Such notice may be provided by posting the changes to the subscription page or by email.
  • The Company shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  • All plans come with a trial period which you can terminate on your own. Once the trial period will get over, the company will charge the amount of subscription, which on failure will freeze your account and be inaccessible.
  • For upgrade/downgrade in plan level will cause the change in services and there will be no proportion in between billing cycles. The customer and company will handle any balance amount separately.
  • Downgrading your Service may cause the loss of services of your account. The Company does not accept any liability for such loss.
  • You are solely responsible for properly canceling your subscription. All of your content will be inaccessible from the Service immediately upon cancellation.
  • If you cancel the Service before the end of your current billing cycle, your cancellation will take effect immediately, and you will not be charged again. But there will not be any prorating of unused time in the last billing cycle.
  • The Company, in its sole discretion, may suspend or terminate your account and refuse all current or future use of the Service for any reason at any time. Such termination of the Service will cause the deactivation or deletion of your Account or your access to your
  • Account, and the forfeiture and relinquishment of all content in your account. The Company reserves the right to refuse service to anyone for any reason.
  • If you do not pay on time, we may suspend or terminate the Services and terminate this agreement. In addition, Third-Party Services may be forfeited. If the Services are suspended because we do not receive payment, we will preserve Customer Content under our normal backup processes and procedures. After that, the Customer Content will be deleted.

12. Return & Refund

  • Content” refers to all text, data, images, video, and other materials created or uploaded by the User or generated through the use of the Platform.
  • Agreement” refers to these Terms and any associated policies, such as the Privacy Policy, governing your use of the Platform.

Scope of Agreement

Agreement to the Terms & Conditions or any other policy does not grant the User any ownership rights to the MakeWebBetter Connect platform or its underlying technology, which remains the sole property of MakeWebBetter.

You are also not permitted to claim intellectual or exclusive ownership of our products and connectors/integrations inside the app, whether changed or unmodified unless agreed otherwise under different clauses by both parties. MakeWebBetter owns all of its software, its functionalities, features, and integrations inside MakeWebBetter Connect until agreed otherwise under special conditions between the parties.

Liability

This agreement also outlines the obligations and responsibilities of both parties. To the fullest extent permitted by law, MakeWebBetter, and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, punitive, consequential, or special damages arising from or related to your use of the Platform, including but not limited to loss of profits, data, or goodwill.

Regarding the use of the Platform, including but not limited to service availability, pricing, user account management, data privacy, and support. Our products are offered “as is,” with no express or implied guarantee of any kind.

In no event shall MakeWebBetter’s total liability to you for any damages, losses, or causes of action exceed the amount you paid to MakeWebBetter in the 12 months or the defined subscription period, preceding the event giving rise to the claim.

Account Registration

Eligibility

  • By creating an account and using the Platform, you represent and warrant that you must have the legal capacity to enter into contracts under the laws of the relevant jurisdiction.
  • If you are registering on behalf of a company or other legal entity, you confirm that you have the authority to bind that entity to these Terms. You agree to comply with all applicable laws and regulations in your use of the Platform and acknowledge that you are not a competitor of MakeWebBetter Connect, nor are you using the Platform for any unauthorized or competitive purposes.

Access and License To Use

To access and use the Platform, the Users are required to create an account by providing accurate and complete registration information, including a valid email address and other required details. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

In order to access and use the Service, you must register for a MakeWebBetter Connect Account. By registering for an account, you agree to:

  • Provide true, current, and complete information during registration and keep it updated as necessary.
  • Maintain the security of your account by keeping your password confidential and not sharing it with others.
  • Notify us immediately if you suspect any unauthorized use of your account or any security breach.
  • Your access to this Account allows access to MakeWebBetter Connect and the Services made available during the period of ownership of this Account, is solely for your own internal business purposes and in accordance with the Terms
  • You further agree that MakeWebBetter will not be liable for any cost, loss, damages, or expenses arising out of a failure by you to maintain the security of your MakeWebBetter Connect Account or your Third-Party Login credentials.

Purchase & Payment Terms

Purchase

By purchasing a subscription or service through MakeWebBetter Connect, you agree to the pricing, features, and terms presented at the time of purchase. Once the payment has been made, the purchase of the platform subscription comes under Terms of Service and are non-refundable unless otherwise stated in these Terms or required by law.

We also reserve the right to change our product prices at any time without prior notice. However, any changes will not affect purchased subscriptions, regardless of whether the subscription is active, pending, or nearing expiration.

Payment

Payments for MakeWebBetter Connect’s subscriptions or services must be made through the authorized payment methods provided on the Platform. In this regard, you agree to provide accurate and complete payment information, and you authorize MakeWebBetter to charge the applicable subscription fees to the payment method you provide. Refer to the Privacy Policy to know about storing of payment data.

Billing

The Subscription fees are billed in advance on a recurring basis, unless stated otherwise. Failure to complete a payment may result in suspension or termination of your access to the Platform until the outstanding amount is settled. MakeWebBetter reserves the right to adjust pricing at any time, but any such changes will not affect existing, paid subscriptions during the active subscription period.

Delivery

Upon successful payment, access to the purchased subscription or services will be activated immediately or within the timeframe specified during the purchase process. You will receive a confirmation email detailing your purchase and any relevant instructions for accessing and using the MakeWebBetter Connect platform. This could take up to an hour, although it usually happens in minutes.

If you haven’t received an email within this time frame or experience any issues accessing your MakeWebBetter Connect or service, then please contact us for assistance.

Taxes

You are responsible for any applicable taxes or charges imposed by governmental authorities (e.g., VAT, sales tax, payment fee) related to your purchase, based on your billing information and your chosen mode of payment.

Support

You receive free-of-cost support on MakeWebBetter Connect purchase. The terms for the duration of the support will be clearly defined at the time of purchase under your chosen plan. The support terms and duration depend on the type of subscription plan you have purchased. All plans include 24/7 support via email and higher tier plans allow priority support, as well. Service Term Period, Renewal and Termination

Service Term Period

The term of your subscription to the Platform will begin on the date of purchase and will continue for the duration specified in the subscription selection. The subscription validity period is clearly outlined at the time of purchase.

Renewal

Renewal of your subscription is entirely voluntary. If you have chosen to renew and have provided your card details, the renewal will be processed automatically at the end of the current subscription term; unless you provide notice of cancellation before the renewal date. You will be notified of any renewal fees, and you may opt out of automatic renewal by adjusting your account settings.

Termination

MakeWebBetter reserves the right to terminate or suspend your access to the Platform or refuse service at any time, temporarily or permanently, any subscription (or part thereof) with or without notice, if you violate the Terms or engage in conduct that is detrimental to the Platform or its users.

We also reserve the right to suspend or terminate accounts, or refuse service, if any information provided during the registration process is inaccurate, false, or if you do not meet the eligibility criteria, or if there is any misuse of the Platform.

Upon termination, your access to the Platform will continue until the end of the current billing cycle.

Prohibitions & Use of the Service

Users of the platform are prohibited from engaging in any activities that may harm the Platform or its users, including but not limited to:

  • You must not violate any guidelines or terms of use stated for the Platform.
  • Copy, alter, create derivative works of, or remove any proprietary notices from the MakeWebBetter Connect.
  • Utilize the Platform to develop products or services that compete with MakeWebBetter Connect.
  • Conduct security assessments, and vulnerability testing, or interfere with the normal functioning of the Platform or its access controls.
  • Provide access to the Platform to non-users, or leverage the Platform to offer a hosted or managed service to third parties; in whole or in part.
  • Reverse engineer, decompile, or attempt to access the source code of the Platform, except where such restrictions are prohibited by law and only after providing prior notice to MakeWebBetter.
  • Otherwise, utilize the Platform in ways that exceed the rights expressly granted herein.

Modifications

If you wish to make any modifications to the applications within the Platform, please contact us directly. You are not authorized to implement changes to the app’s interface, functionalities, integrations, and other modifications, unless obtaining clear authorization from MakeWebBetter. Unauthorized modifications may result in the suspension or termination of your access to the Platform.

Service Warranty & Indemnification

Warranty

MakeWebBetter warrants that the MakeWebBetter Connect platform will perform substantially in accordance with the terms provided. However, no warranty is made that the Platform will be error-free or uninterrupted. If a defect arises in the Platform during the warranty period, your sole remedy and MakeWebBetter’s only obligation will be to either repair or replace the affected product or service at no additional cost.

Indemnification

You agree to indemnify, defend, and hold harmless MakeWebBetter, its officers, directors, and employees from any claims, losses, liabilities, damages, expenses, or costs (including reasonable attorney fees) arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

Updates

Customers who have made a purchase and maintain an active license are eligible for product updates. While all products are designed to work with the latest versions of connected apps, MakeWebBetter cannot guarantee compatibility with future versions of those apps. Nevertheless, we are dedicated to ensuring that all products remain compatible with upcoming updates to the Platform to the best of our ability.

Confidentiality

Agreement to Terms also entails that both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of this Agreement. This obligation extends to all information, whether written, oral (demos), or electronic, that is designated as confidential or that reasonably should be understood to be confidential due to the nature of the information and the circumstances of its disclosure. The confidentiality obligation will survive the termination of this Agreement.
